Do we need to implode the Department in order to do so? No

Facts on President Trump's Plans for the U.S. Department of Education! 

• Jeff Mason Reports: On Feb. 4, 2025, White House Correspondent Jeff Mason (Reuters) shared that discussions in the Oval Office involved shuttering the Education Department.
   
• Trump mentioned telling Linda McMahon—who was eyed to be Secretary of Education—that once confirmed, she should essentially “put herself out of the job.”
   
• The 90-Day Kickoff: A White House official confirmed that an executive order is expected to launch a 90-day review process to begin the department’s winding down.

• Key Fact: The process will involve working closely with Congress since closing a Cabinet department without legislation isn’t possible.
• Congressional Involvement: The President has stated he will work with Congress to move forward—because to fully abolish the department, you’d need a 60-vote majority in the Senate.
• This is why abolishing the department entirely would require an act of Congress. (we know Trump follows the laws)
• Campaign Promises & Legislative Moves: 
  Trump campaigned on a promise to end the U.S. Department of Education, and many Republicans in Congress back this sweeping step.
• On the campaign trail and in interviews (with Elon Musk and on “Fox & Friends”), Trump repeatedly said he wants to shutter the agency.
• Trump's Agenda47 policy platform even calls for sending all education work back to the states.
• Draft Order Insights: A draft of Trump’s order—obtained by the Washington Post—acknowledges that while executive action can direct the department to wind down, only Congress can fully eliminate it.
• Trump has said he’d “like to be able” to close the department with an executive order alone, but real change requires congressional action.
• Workforce & Accountability: The Education Department employees are among those targeted in the broader push to shrink the federal workforce.
• The department plays a crucial role in enforcing non-discrimination laws like Title IX, the Rehabilitation Act, the Americans with Disabilities Act, and Title VI, IDEA, and holds schools accountable under the Every Student Succeeds Act.
• Legislative Efforts: Kentucky Representative Thomas Massie has reintroduced a bill aiming to abolish the U.S. Department of Education by the end of 2026.
